Eureka Hospitality Group – 7-Day Coffee Pass Terms and Conditions

Welcome to the Eureka Hospitality Group 7-Day Coffee Pass (the “Pass”). These Terms and Conditions (the “Terms”) govern your purchase and use of the Pass at your selected Eureka Hospitality Group venue in Australia.

By purchasing, activating, or using the Pass, you agree to be bound by these Terms. Please read them carefully.

1. The Promoter

The Pass is operated and promoted by Eureka Hospitality Group (referred to as “we”, “us”, or “our”). Our registered business address for queries relating to this Pass is accessible via our customer service at (03) 9376 2906 or via eurekahospitality.com.au.

2. Eligibility

2.1. The Pass is available to individual customers aged 16 years or older.

2.2. The Pass is strictly for personal use. It cannot be shared, transferred, sub-licensed, or resold to any other person.

2.3. Corporate accounts, wholesale customers, and third-party delivery services (e.g., UberEats, DoorDash) are not eligible to purchase or use the Pass.

3. Pass Benefits

During the 7-day validity period, the registered Pass holder is entitled to:

3.1. Free Coffee: One (1) standard barista-made coffee per day for seven (7) consecutive days. (Add-ons such as alternative milks, extra shots, or flavor syrups may incur an additional standard surcharge, at the discretion of the venue).

3.2. 25% Discount: A 25% discount on all other full-priced food and beverage items purchased in-store during the validity period.

4. Validity and Expiry

4.1. Activation: The 7-day validity period commences on the day following the date of purchase (the “Start Date”) and runs for seven (7) consecutive calendar days.

4.2. Expiry: The Pass automatically expires at the end of the 7th consecutive day, regardless of how many coffees were redeemed or discounts utilized.

4.3. No Rollover: Unused daily coffees do not roll over to the following day. If you do not claim your free coffee on a given day, it is forfeited.

4.4. Participating Venues: The Pass is strictly linked to the specific Eureka Hospitality Group venue where it was originally purchased. It can only be redeemed at that specific purchase venue and is not valid or redeemable at any other Eureka Hospitality Group locations.

5. Redemption and Fair Use

5.1. App Requirement: To redeem the Pass benefits, the Pass holder must download the designated Eureka Hospitality loyalty mobile application (the “App”). The digital Pass must be presented via the App to staff at the point of sale prior to completing the transaction. Physical cards or screenshots are not accepted.

5.2. We reserve the right to request valid photo identification to verify that the person presenting the Pass via the App is the registered account holder.

5.3. Promotional Offers: The Pass benefits (including the 25% discount) may occasionally be used in conjunction with other promotional offers at our discretion. However, any such additional promotional offers are not guaranteed, are not compulsory, and are subject to change, modification, or withdrawal at any time without prior notice.

5.4. Misuse: Any abuse of the Pass—including but not limited to sharing the App account with others, attempting to claim multiple “free” coffees in a single day, or aggressive behavior toward staff—will result in immediate cancellation of the Pass without refund.

6. Purchasing, Cancellations, and Refunds

6.1. The Pass fee must be paid in full upfront at the time of purchase.

6.2. Subject to your rights under the Australian Consumer Law, the Pass is non-refundable, non-exchangeable, and cannot be redeemed for cash or credit.

6.3. We do not provide partial refunds if you are unable to visit the venue during your 7-day period.

7. Changes to the Program

7.1. We reserve the right to amend, suspend, or terminate the 7-Day Coffee Pass program at any time.

7.2. If we make material changes to these Terms that adversely affect active Pass holders, we will honor the core benefits (1 daily coffee and 25% discount) of any currently active Pass until its 7-day period expires, ensuring compliance with Australian Consumer Law regarding unfair contract terms.

8. Australian Consumer Law (Limitation of Liability)

8.1. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you may have under the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be lawfully excluded.

8.2. To the maximum extent permitted by law, Eureka Hospitality Group’s liability for any breach of these Terms or related to the Pass is limited to either supplying the services again or refunding the cost of the Pass.

8.3. We are not liable for any temporary venue closures, equipment failures, or unforeseen circumstances that prevent you from redeeming your Pass on a specific day.

9. Privacy

9.1. By registering for the Pass and downloading the App, you consent to Eureka Hospitality Group collecting and using your personal information (such as name, email, and purchase history) to administer the program.

9.2. Your information will be handled in accordance with our Privacy Policy and applicable Australian privacy laws. We may occasionally send you marketing updates, which you can opt out of at any time.

10. Governing Law

These Terms are governed by the laws in force in Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.
